Paradigma Perlindungan Hukum bagi Nazhir dalam Kasus Sengketa Wakaf

Abstract
Disputes over waqf land often involve complex issues that affect the sustainability and utilisation of such land. This qualitative research, in the form of a normative study of Islamic law, aims to describe the legal protection framework for the nazhir in disputes over the possession of waqf land by third parties, as set out in the Decision of the Cilegon Religious Court No. 279/Pdt.G/2017PA.Clg. Research results show that the PA decision establishes the position of nazhir as a legitimate party in the management of waqf land. Such a conclusion is due to the Panel of Judges in its considerations recognizing the Waqf Pledge Deed as authentic evidence that has legal force in considering the disputed land as valid waqf property. The contribution of this research emphasizes that legal protection for the nazhir is normatively available, but its effectiveness depends on administrative certainty and consistency in law enforcement.
